Welcome to Old Josephs ("Old Josephs," "Company," "we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of OldJosephs.com (the "Site") and your participation in the Old Josephs' Membership program ("Membership").
By accessing the Site or purchasing a Membership, you agree to these Terms.
1. Membership Purchase; Not a Sale of Alcohol
Old Josephs offers a subscription-based membership program.
Your purchase constitutes the purchase of access to the Old Josephs' Membership and its associated benefits.
You are not purchasing alcohol from Old Josephs.
Where permitted by law, certain Membership benefits may include access to limited-release spirits. Any alcoholic beverages are:
- Sold by independent, properly licensed third-party alcohol retailers
- Fulfilled by those retailers
- Transferred directly from the retailer to the member
Old Josephs does not sell, ship, or distribute alcohol.
2. Eligibility; Age Requirement
Membership is available only to individuals who:
- Are at least 21 years of age
- Reside in jurisdictions where Membership is lawful
Proof of age may be required prior to the fulfillment of any Membership benefit involving alcohol.
Old Josephs reserves the right to cancel Membership if eligibility requirements are not met.
3. Membership Benefits
Membership benefits may include, without limitation:
- Access to limited or private releases
- Allocations fulfilled by licensed retail partners (where permitted by law)
- Priority access to future offerings
- Educational content
- Member communications
- Invitations to private or member-only experiences
Benefits may vary by jurisdiction and availability.
Old Josephs does not guarantee availability of specific products or releases.
4. Third-Party Alcohol Fulfillment
Any alcoholic beverage made available as part of Membership benefits is:
- Sold by an independent, properly licensed alcohol retailer
- Subject to that retailer's terms and conditions
- Transferred directly from the retailer to the member
Title and ownership pass from the licensed retailer to the member.
Old Josephs does not take title to alcoholic beverages and does not act as the seller of record.
5. No Allocation of Membership Fee to Alcohol
The Membership fee is charged solely for access to the Membership program and its associated benefits as a whole.
No portion of the Membership fee:
- Is allocated to the purchase of alcohol
- Represents consideration for alcoholic beverages
6. Subscription Billing; Renewals
Membership is offered on a subscription basis (monthly, annual, or as otherwise described at checkout).
By purchasing Membership, you authorize Old Josephs to charge your payment method on a recurring basis until cancellation.
Membership fees are non-refundable except where required by law.
You may cancel your Membership at any time through your account settings or by contacting support. Cancellation applies to future billing periods.
7. Availability; Substitution of Benefits
Certain Membership benefits may be unavailable due to:
- State or local law restrictions
- Regulatory limitations
- Logistical constraints
- Supply limitations
If a benefit involving alcohol cannot be fulfilled, Old Josephs reserves the right to substitute an alternative benefit of comparable value.
No refunds will be issued solely due to unavailability of a specific release.
8. Compliance With Laws
Members are responsible for compliance with all applicable federal, state, and local laws regarding alcohol possession and consumption.
Membership benefits involving alcohol are void where prohibited.
9. Prohibited Use
You may not:
- Use the Site for unlawful purposes
- Misrepresent your age or identity
- Attempt to resell Membership benefits
- Interfere with the Site's operation
We reserve the right to suspend or terminate accounts for violations.
10. Intellectual Property
All content on the Site, including:
- Trademarks
- Logos
- Brand names
- Text
- Images
- Designs
is owned by Old Josephs or licensed to us.
You may not reproduce or use our intellectual property without written permission.
11. Disclaimer of Warranties
The Site and Membership are provided "as is" and "as available."
Old Josephs makes no guarantees regarding:
- Availability of specific releases
- Shipping timelines (handled by third-party retailers)
- Continuous Site availability
12. Limitation of Liability
To the fullest extent permitted by law, Old Josephs shall not be liable for:
- Indirect or consequential damages
- Delays caused by third-party retailers
- Regulatory restrictions affecting fulfillment
Total liability shall not exceed the Membership fees paid in the preceding 12 months.
13. Indemnification
You agree to indemnify and hold harmless Old Josephs from any claims arising from:
- Your misuse of Membership
- Violation of law
- Breach of these Terms
14. Governing Law
These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles.
15. Modifications
Old Josephs may update these Terms at any time. Updated Terms will be posted on the Site with a revised effective date.
Continued use of the Site or Membership constitutes acceptance.
